- END-USER LICENSE AGREEMENT (EULA) FOR BIG GREEN BAY
- IMPORTANT-READ CAREFULLY: This End-User License Agreement (“EULA”) is a legal agreement between you (either an individual or a single entity) and the owner of this online marketplace (the “Owner”). This EULA governs your use of the online marketplace and any related services provided by the Owner (collectively, the “Service”). - OWNERSHIP
- The Service is owned and operated by the Owner. The Owner and its licensors own all rights, title, and interest in and to the Service, including all intellectual property rights therein. You acknowledge that you have no right to have access to the Service in source-code form.
- DISCLAIMER OF WARRANTIES
- The Service is provided “as is,” without warranty of any kind, either express or implied, including without limitation any warranty for information, services, uninterrupted access, or products provided through or in connection with the Service, including without limitation the software licensed to you and the results obtained through the Service. Specifically, the Owner disclaims any and all warranties, including without limitation: 1) any warranties concerning the availability, accuracy, usefulness, or content of information, products, or services; and 2) any warranties of title, warranty of non-infringement, warranties of merchantability, or fitness for a particular purpose.
- LIMITATION OF LIABILITY
- In no event shall the Owner be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the use or inability to use the Service, including without limitation damages for loss of profits, loss of data, business interruption, or any other commercial damages or losses, even if the Owner has been advised of the possibility thereof.
- INDEMNIFICATION
- You agree to indemnify, defend, and hold harmless the Owner, its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising from your use of the Service or your violation of this EULA.
- TERMINATION
- This EULA is effective until terminated by either party. You may terminate this EULA by discontinuing use of the Service. The Owner may terminate this
- EULA immediately if you breach any term or condition of this EULA. Upon termination of this EULA, you must cease all use of the Service and destroy all copies of the Service in your possession or control.
- CHANGES TO THE EULA
- The Owner reserves the right to modify this EULA at any time by posting the updated version on the Service. Your continued use of the Service after any such changes constitute your acceptance of the revised EULA.
- GOVERNING LAW
- This EULA shall be governed by and construed in accordance with the laws of [Jurisdiction], without regard to its conflict of laws principles.
- ENTIRE AGREEMENT
